Opposed Trademark: Liang Xian Shen COOLHITTO

Focus of the Case: The opposing party is suspected of forging or altering invoices

  Our client is the true owner of the "Liang Xian Shen COOLHITTO" series trademark. The opposing party cited the subsequently applied "Liang Xian Shen" trademark and filed an opposition against our client's preliminary announcement of "Liang Xian Shen COOLHITTO," claiming that our client infringed on their prior use and influential trademark, and provided sales invoices as evidence.

  We found that the invoices provided by the opposing party are suspected of being forged or altered. Among the four invoices provided by the opposing party, the issue dates of the three invoices with smaller invoice numbers are all October 16, 2015, while the issue date of the invoice with the largest invoice number is October 16, 2012. This invoicing method is simply impossible! In tax practice, tax control machines issue invoices in order from smallest to largest invoice number. The opposition defense in this case was ultimately successful, and our client's trademark was successfully approved for registration.
