“Haitain” withdraws three appeals

Client Qingdao Haitai Grand Hotel Co., Ltd. (hereinafter referred to as "Haitai") first applied for registration of the trademark in dispute in this case, namely the Class 41 trademark No. 774243 "Haitai", for services such as "entertainment activities, public amusement parks, provision of entertainment facilities, arranging and organizing conferences, entertainment, fitness clubs, nightclubs, organizing sports competitions", as early as September 1993. The opposing party, Hong Kong Wuyou Trade Co., Ltd. (hereinafter referred to as "Wuyou"), filed five applications for cancellation of the services of trademark No. 774243 in 2020.
Qingdao Haitai Grand Hotel was once the best sea-view green hotel in Qingdao and one of the earliest and largest five-star hotels in Shandong Province, and a member unit of the World Hotels Organization. In order to better serve the public and innovate, the hotel was demolished on June 10, 2013, and will be rebuilt on the original site as a landmark building in Qingdao - Haitai Center (the project has just been topped out). Through my agency's assistance to the client Haitai and its affiliated companies, Qingdao Haitai Grand Theatre Hotel, Haitai Hongdao International Convention and Exhibition Center Hotel, and Qingdao Haitai Grand Hotel Co., Ltd. Haitai Sports Center Hotel, signed trademark license agreements to prove that during the specified period, the client Haitai and its affiliated companies jointly used the "Haitai" trademark for the above-mentioned service items. And assist in finding online evidence to match the client's WeChat public account promotion and local newspaper promotion, etc., to prove that the respondent has conducted extensive publicity for the above-mentioned services, which has achieved certain results, and customers have successively reached service intentions. Through my agency, the client Haitai's "Haitai" Class 41 trademark has successively received decisions from the Trademark Office regarding the application for cancellation of the Class 41 "Haitai" registered trademark No. 774243 for three consecutive years of non-use, and the decision not to cancel the registration for the designated service items.
